Privacy Statement

1. Who we are

amardrive ("amardrive", "we", "us") is a personal cloud storage service. This statement explains what personal data we collect, why, and the rights you have.

The data controller is Kernelv5, Inc., a Delaware C Corporation (Delaware file no. 2668870), [Delaware registered-agent street address].

2. Data we collect

Account data — your name, email and profile picture, provided through Google Sign-In.
Your files & metadata — the files you upload, plus file names, sizes, folders and timestamps.
Billing data — your plan and payment status. Card details are handled by Stripe; we do not store your card number.
Device & usage data — linked devices, IP address, and basic activity logs used to operate and secure the service.
Analytics — anonymous usage statistics via Google Analytics, only if you consent (see Cookies below).

3. How we use your data, and our legal basis

To provide the service and your account — performance of a contract.
To process payments and manage subscriptions — performance of a contract.
To keep the service secure and prevent abuse — legitimate interest.
To measure usage with analytics — your consent.
To meet legal and tax obligations — legal obligation.

We do not sell your personal data, and we do not use your files for advertising or profiling.

4. Security

      Your files are encrypted at rest with AES-256 and in transit with TLS, and stored on Cloudflare R2 infrastructure.
    

For transparency: amardrive is not an end-to-end ("zero-knowledge") encrypted service. To provide features such as thumbnails, previews and web access, our systems are technically able to process your file contents. We access file contents only to operate, secure and support the service, or where the law requires it — never to sell or exploit them.

5. Sub-processors

Cloudflare — hosting, file storage (R2) and database.
Google / Firebase — sign-in and authentication.
Stripe — payment processing.
Google Analytics — usage analytics (consent-based).
[Email provider] — transactional emails.

6. Data retention

We keep your data while your account is active. When you delete your account, your files and personal data are permanently erased after a short grace period (currently 15 days), except limited records (e.g. invoices) we must keep for legal reasons.

7. Children

amardrive is not intended for anyone under 16. We do not knowingly collect data from children.

This section applies if you are in the European Economic Area (EEA), the United Kingdom, or Switzerland, and supplements the Privacy Statement above. Where this notice and the statement differ for EEA/UK users, this notice prevails.

Legal bases (Art. 6 GDPR)

We process your data under: contract (to run your account and billing), consent (analytics cookies), legitimate interests (security and abuse prevention), and legal obligation (tax and compliance records).

Your rights

Access — get a copy of your data.
Rectification — correct inaccurate data.
Erasure — delete your data ("right to be forgotten").
Portability — receive your data in a portable format.
Restriction / objection — limit or object to certain processing.
Withdraw consent — at any time, e.g. switch analytics off in Cookies below.

You can exercise most rights directly in the app (e.g. delete your account) or by emailing connect (at) amardrive (dot) com. We respond within one month.

Automated decision-making

We do not make decisions with legal or similarly significant effects based solely on automated processing or profiling.

International transfers

Your data may be processed in the United States and other countries. Such transfers are protected by appropriate safeguards, including the EU Standard Contractual Clauses (and the UK Addendum where applicable).

Right to complain

You can lodge a complaint with your local supervisory authority — for example your national Data Protection Authority in the EEA, or the Information Commissioner's Office (ICO) in the UK.

Terms of Use

1. Agreement

These terms are a contract between you and Kernelv5, Inc., a Delaware C Corporation ("amardrive", "we", "us"). By creating an account or using amardrive, you agree to them.

2. The service

amardrive is a personal cloud storage service for individual use. Accounts are for a single person and are not transferable. Each plan allows a set amount of storage, a maximum number of linked devices, and a maximum file size, as shown on our pricing page.

3. Eligibility

You must be at least 16 years old and able to enter a contract to use amardrive.

4. Your account

You sign in with your Google account; you are responsible for keeping access to it secure.
One account is for one person — do not share your credentials.
You are responsible for activity under your account.

5. Plans, billing & cancellation

Paid plans are billed in advance through Stripe on a recurring (monthly) basis and renew automatically until cancelled.
You can cancel at any time; your plan stays active until the end of the current paid period.
A free plan is available and does not require payment.
Except where the law requires otherwise (including the EU/UK 14-day right of withdrawal), payments are non-refundable.
Prices may change; we will give reasonable notice before a change affects you.

6. Acceptable use

You agree not to use amardrive to store or share content that is illegal, infringing, or malicious (e.g. malware), and not to abuse, overload, or attempt to break the service. You must stay within your plan's limits.

7. Your content

Your files are yours. We claim no ownership of them.

You grant us only the limited permission needed to store, process and display your files so we can provide the service to you (for example creating thumbnails and previews). You are solely responsible for the content you store and for keeping your own backups.

8. Suspension & termination

If a payment fails or you breach these terms, your account may be locked after a grace period and, if unresolved, your data may be deleted. You can delete your account at any time from within the app.

9. Service "as is"

We work hard to keep amardrive reliable, but the service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation, and you remain responsible for maintaining your own copies of important files.

10. Limitation of liability

To the maximum extent permitted by law, amardrive is not liable for indirect, incidental or consequential damages, or for loss of data beyond the amount you paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.

11. Changes & governing law

We may update these terms; material changes will be notified in the app or by email. These terms are governed by the laws of the State of Delaware, USA, and disputes will be handled by the courts located in Delaware, unless mandatory consumer law in your country says otherwise.
